Bombay High Court provides temporary reprieve to Delta Corp over GST notification

The Goa Bench of the Bombay High Court has issued an injunction, preventing tax authorities from issuing a final order on the Rs 16,195-crore ($1.95 billion) GST notice served to India’s gaming operator, Delta Corp.

The Goa bench has instructed the Directorate General of GST Intelligence, Hyderabad, not to make any final determinations regarding the $1.95 billion tax notice without obtaining prior permission.

Last month, the tax authorities had issued show cause notices to the casino company and its subsidiaries, demanding payment for a tax shortfall amounting to a substantial Rs 23,000 crore ($2.77 billion).

Earlier, Sikkim High Court issued a temporary halt to the $76 million tax claim against Delta Corp.

In a stock exchange filing, the gaming operator said dates are fixed for completion of pleadings, and the hearing and final disposal of the writ petition filed.

“The Hon’ble High Court of Bombay at Goa considered the writ petitions filed by the Company and its subsidiaries on 23rd October 2023. Based on a statement made on behalf of the concerned tax authorities, the Hon’ble High Court has directed such authorities not to pass any final orders on the captioned show cause notices without the prior permission of the Hon’ble High Court. Dates have been fixed for completion of pleadings, and the hearing and final disposal of such writ petitions,” Delta Corp said in filing.
